Harbor Ridge HOA Storage Area Lease Agreement

 

This lease Agreement (this “Lease”) is made effective by and between the Harbor Ridge Homeowners Association, Inc (Lessor) and _______________________________________(Lessee Name)

The parties agree as follows:

Premises. The Lessor, in consideration of a fee, leases to the Lessee,  One (1) storage space in the Harbor Ridge Boat Storage Area.

Term. The term of this Lease shall commence as of the date hereof and shall terminate immediately upon Lessee's conveyance of their Lot to a third party.

Lease Payment(s). Lessee shall pay a one-time fee to the lessor of fifty dollars ($50.00).

Possession. Lessee shall be entitled to possession on the first day upon paying the required fee, unless otherwise agreed upon by both parties in writing.. This Lease will automatically resume assuming the Lessee is “in good standing” with the Lessor. Lessee is required to follow all Harbor Ridge covenants and conditions.  In the event Lessee shall fail to perform any of the covenants, agreements or obligations set forth by the Harbor Ridge HOA, Lessor shall, have the right, to terminate this Lease, in which event Lessee shall immediately surrender possession of the Premises to Lessor.

Use of Premises. Tenant shall occupy and use Premises as a storage space only. A boat trailer, empty or loaded, a personal watercraft trailer, empty or loaded, a non-motorized camper trailer of less than 24 feet in length; or an empty utility trailer of less than 24 feet in length are the only types of vehicles that may be parked in the leased parking area.  No motorized vehicles other than a boat or personal watercraft may be parked in the leased parking area overnight.  Vehicles parked in violation will be towed to a compound and stored at the owner’s expense.

Property Insurance. The Lessor and the Lessee shall each be responsible to maintain appropriate insurance for their respective interests in the premises.  Upon Lessor's request and upon completing a Lease Application, Lessee shall furnish to Lessor copies of policies or certificates of insurance evidencing the required insurance coverage.  Lessee hereby waives Lessee's right of subrogation against Lessor.  Harbor Ridge Homeowners Association shall not be liable in any manner for the safekeeping or condition of any boat, trailer, or other item belonging to or used by Lessee or members of Lessee's household. Lessor shall not be responsible or liable for any damage or loss to or of Lessee's boat, its tackle, gear, equipment or property either upon the boat or upon the Premises from any cause whatsoever.  The provisions of this paragraph shall insure to the benefit of and shall be binding upon Lessor and Lessee and their respective heirs, representatives, successors in interest and assigns.

Ownership/Assignability/Subletting. It is a condition of this Lease that the Lessee shall own a Lot within the community of Harbor Ridge.  This Lease shall not be assignable (even to a subsequent purchaser of the Lot) without the prior written consent of Lessor, which may be granted or denied by Lessor in its sole and absolute discretion.

Notices. Notices under this Lease shall not be deemed valid unless given or served in writing and forwarded by mail, postage prepaid, and addressed to the party at the appropriate address, set forth below.  Such addresses may be changed from time to time by either party by providing notice.

Defaults. Lessee shall be in default of this lease if Lessee fails to fulfill any obligation or term by which lessee is bound.  Subject to any governing provision of law to the contrary, if Lessee fails to cure any lease violation within ten (10) days of any written notification of default, Lessor may take possession of the Premises without further notice and without prejudicing Lessor’s right to damages.  Lessor shall pay all costs, damages and expenses (including reasonable attorney fees) suffered by Lessor by reason of Lessee’s default.

Release and Indemnity. Lessee  covenants to indemnify, defend and hold harmless Lessor and Lessor's successors  and assigns, from and against any and all claims, liability, loss or damage arising from any conduct, act or omission taken under this Lease, including, without limitation, injury or damage, however caused, to any person or persons or to the property of any person, persons or corporations occurring on or near the Premises or the Storage Area as a result of any activity of Lessee or Lessee's guests, invitees, agents, employees, contractors or subcontractors, including all costs, counsel fees, expenses, liabilities and damages incurred in or about such claim or any action or proceeding brought thereon: and in the event any action or proceeding shall be brought against Lessor, their successors or assigns, by reason of any such claim, Lessee, on notice from Lessor, shall resist and defend such action or proceeding by counsel satisfactory to Lessor. Lessee hereby waives all claims against Lessor for damages to the Premises and all boats, boat trailers, equipment and other personal property of Lessee therein or thereon resulting from any cause whatsoever.
